All bookings shall be bound by the terms and conditions detailed below on this page, and all that of its contracted third parties (all services) and any other procedures or directions reasonably given by the Operator SARL Leyshon, trading as Chamonix Exclusive, its employees, and contractors.

These Terms and Conditions shall at all times take precedence over all other communications, including the Rental Agreement. Hereinafter SARL Leyshon shall be referred to as “Chamonix Exclusive” and such reference to Chamonix Exclusive (CE) shall refer and apply to SARL Leyshon.

SARL Leyshon are a French registered business operating in France, French Law shall therefore apply at all times. In the unlikely event of a formal dispute ascertaining or otherwise to these Terms and Conditions we reserve the right to ask for all correspondence to be in French only.

STANDARD TERMS AND CONDITIONS

1. Booking

 

All Bookings made direct with Chamonix Exclusive must be accompanied by a ‘Deposit’, of 20% for catered holidays and 35% for self catered holidays, of the total holiday price, where booked through an agency the higher deposit rate will apply. Reservations can only be confirmed on receipt of the full Deposit.

 

The contract will take effect on receipt of the full Deposit and Chamonix Exclusive (or acting agent for CE) has issued confirmation of receipt of payment. The remaining balance is due 10 weeks prior to your holiday start date. Full payment will be required for bookings made within 10 weeks of your holiday.

 

In the event that the remaining balance is not received 10 weeks prior to your holiday start date, Chamonix Exclusive will make reasonable endeavours to remind the client of monies due to expedite payment. Ultimately Chamonix Exclusive reserve the right to cancel the booking without further reference to the client and in such cases the client shall forfeit any Deposit paid.

 

2. Payments

 

Holiday Payment:

 

Clients (person, persons or organisation making the booking) may pay for their holiday by bank transfer in pounds or euros. Payments by bank transfer must be made prior to the due date and allowing appropriate time for international banking clearance to ensure payment is made on time.

All charges (e.g. international transfer costs, etc.) must be paid by the client. In the event of charges being incurred or deducted by the bank prior to being received by Chamonix Exclusive, Any such charges not covered by the client will be billed back to them and Full Payment of the holiday will not be considered to have taken place until such time as the charge has been remedied by the client.

 

Additional in resort payments:

 

During your stay at Ski In Ski Out Chalet No.5 the payment of services will be charged in euros and as such euro cash payments or euro bank transfers are welcome. For clients who wish to settle their bill in sterling this is possible with prior agreement from Chamonix Exclusive. All such payment must be paid and cleared 48 hours before the end of the holiday duration. Chamonix Exclusive will offer an exchange / conversion rate according to and based on current exchange rates.

 

Chamonix Exclusive will advise if credit cards payments are possible and will advise the appropriate fee rate.

 

All bills must be settled before exiting the chalet.

 

3. Flights & Ferries

 

Flights or ferries (‘carriers’) are not included within the holiday price and as such is deemed to be the sole responsibility of the client. Any Carriers (flights and ferries) shown on this website or referenced by Chamonix Exclusive and its employees are for information purposes only and Chamonix Exclusive does not warrant their fitness for purpose in any form. No liability will exist between the client and Chamonix Exclusive for any failure by a carrier to deliver the services contracted, including, but not exhaustive of late arrivals or departures in any event, including events considered a Force Majeur event.

 

4. Arrivals and Departures

 

Airport transfers from and to Geneva Airport are available on request and on behalf of the client from our airport transfer partners. To book the lead name and a contact mobile number is required, together with the number in the party, and all flight numbers, dates, times arriving and departing.

Whilst we endeavour to keep our prices upto date, prices may be subject to change and in such changes will be notified to you for your acceptance or otherwise prior to booking and acceptance.

 

Such transfers are provided by a third party provider and will be subject to their Terms and Conditions – a copy can be provided on request.

 

Chalet Access:

 

Access to Ski In Ski Out Chalet No.5 is available from 16:00 and departure must be no later than 10:00 am on departure (check out) day.

 

Typically, airport transfer journey times take around 1hour 15 minutes but we suggest you allow at least 2 hours from your flight arrival time to arrival at the chalet and 4 hours from the chalet to your flight departure time.

 

Flight arrivals and departures are therefore best booked between 1pm and 4pm. Chamonix Exclusive will do their utmost to accommodate early arrivals or late departure times, however, where these times conflict with other guests Chamonix Exclusive reserve the right to refuse access to the chalet.

 

Arrival:

 

Ski In Ski Out Chalet No.5 is offered on a ‘sole residency’ basis. Chamonix Exclusive employees an providers are not therefore on site. Please ensure you notify the designated contact of your estimated arrival time to ensure access to the property on arrival. Failure to do so may result in being delayed access.

 

If you are delayed, please notify the designated contact of your new estimated arrival time, ideally, and when possible, at least 60 minutes before the original time. A charge will apply for waits not notified that exceed 60 minutes beyond the arrival time at the rate of:

 

£35 per additional(and part) hour.

 

Child seats:

 

The correct size baby seat must be requested, or the age and weight of the child specified. For your convenience a general guide has been provided but parents are responsible for the safety of their child at all times and ensuring the correct seat is used:

 

  • Rear facing baby seat, group 0: up to 13kgs (29lbs), approx age range: birth to 12-15mths
  • Front facing child seat, group 1/2/3: from 9-25kgs (20-40lbs), approx age 9mths – 4 years
  • Booster cushion, group 3/4: from 22-36kgs (48-79lbs) approx age 6-11/12 years Booster cushion
  • Children smaller than 135cm must use one of the appropriate sized seats stated above.

 

Please note that the third party provider may refuse to carry children where the correct sized safety seat has not been requested and this will be at the Clients responsibility for any additional costs that are incurred as a consequence (e.g. solutions such as rebooking, correct seats needing to be sent, etc.).

 

The third party transfer partners will endeavour to honour special requirement requests, such as the provision of child restraint seats, but are not contractually obliged to do so.

 

Self-Driving:

 

Clients arriving by car must park in the designated areas as directed by our Chamonix Exclusive and representatives of. There are 2 to 3 car parking spaces at the chalet. Snow conditions may dictate that the number of cars parking on the property may be limited however from time to time.

 

Clients must not block the driveway in part or whole when parking their vehicles and ensure access to Ski In Ski Out Chalet No.5 and the adjacent property behind.

 

Snow tyres and cars with 4 x 4 are highly recommended. Snow chains are obligatory on the road up to Ski In Ski Out chalet No.5 when the roads are snow covered.

 

 

5. Chauffeured In-Resort Driver Service (Available Winter Ski Season Only):

 

Chamonix Exclusive Third Party Provider will provide an in resort on call driver service between 08:00hrs and 20:00hrs Sunday to Friday within the Chamonix Valley.

 

This service includes 1 (one) minibus capable of carrying 8 passengers. Please note that this service is an ‘on call’ service and the driver should therefore be given advance notice of the time and place of the collection to avoid unnecessary waiting. This said, from time to time road conditions, unforeseen circumstances, etc. may occasionally lead to some delays.

 

The driver will undertake best endeavours to respond to any call not booked within the times stated above. The driver will endeavour to reach the client within 30 minutes of calling where this is practical, however this timing will be longer where no prior notice has been given or there are adverse weather conditions or unforeseen circumstances.

 

The Chamonix Valley area is deemed to be from Les Houches to Le Tour (excludes Vallorcine and the pass Col des Montets). Requests outside the Chamonix Valley may be agreed between Chamonix Exclusive and the client, but surcharges may apply. For transport to and from the restaurant the times must be notified to the driver 24 hours in advance.A second minibus may be requested at an additional cost as stated on the Concierge Transport page (link provided above).

 

6. General Terms of Use of Chamonix Exclusive Transfers, Vehicles and Related Services

 

Chamonix Exclusive and its transfer partners reserve the right to refuse to carry any client, at any time, whose behaviour may be inappropriate, as deemed by the staff of Chamonix Exclusive and or its Third Party Transfer partner, or is deemed to be under the influence of alcohol, drugs, etc. and could put their transportation, other clients, staff, or the property of Chamonix Exclusive and its transfer partner at risk.

 

For any damage or cleaning that is a result of a client’s inappropriate behavior, the full cost of rectification will be charged to the client. The minimum charge that shall apply in such an event shall be £300 plus the costs of any applicable damage or cleaning to the vehicle.

 

Children travelling in a vehicle must at all times use the child restraint seats provided. Clients must advise of any children requiring by law, or otherwise, a child restraint seat with your booking. The children’s parent’s or guardian are responsible at all times for ensuring that the children under their care are properly restrained in the restraints provided and any safety seats are safely fitted prior to traveling. Chamonix Exclusive and its transfer partner reserves the right to withhold transport for children in the event of not being notified of a child’s seating requirement and a child restraint seat as a consequence not being available.

 

All clients, whatever age must wear properly the safety restraints fitted in any vehicle operated by Chamonix Exclusive and its Third Party Transfer partner. Please note that vehicles provided by Chamonix Exclusive and its Third Party Ttransfer partner must not exceed the authorised passenger carrying capacity and Chamonix Exclusive and its transfer partner drivers will therefore not carry over the legal capacity.

 

Please note: Additional terms and conditions may apply in respect of the Third Transfer partner’s specific terms and conditions and apply accordingly. Copies can be provided on request.

 

7. Insurance

 

Your booking does not include travel insurance. We strongly advise that all members of your party have the appropriate travel insurance in place prior to travelling.

 

8. Changing Your Booking

 

If you wish to make alterations to your booking after the contract is formed, we will seek to accommodate your request where it is reasonable to do so. Such changes are at the sole discretion of Chamonix Exclusive.

 

9. Cancellation Of A Holiday By The Customer

 

If you choose to cancel your holiday you must do so in writing. The date of cancellation shall have taken effect when Chamonix Exclusive receives cancellation. The person submitting the booking form must authorise cancellation. Cancellation charges for the accommodation cost will be as follows:

 

PERIOD BEFORE ARRIVAL – WRITTEN CANCELLATION IS RECEIVED

  1. Cancellation made more than 10 weeks before arrival date – Loss of deposit
  2. Cancellation made less than 10 weeks before arrival date 100% of holiday cost

Please note, that if your cancellation falls within your insurance policy terms, you may be able to reclaim any costs or charges.

 

10. Changes Made By Chamonix Exclusive

 

Many holidays are booked well in advance of the arrival date, whilst we do everything possible to meet the requirements of our customers, specifications, descriptions and the terms detailed on this website, inevitably some changes do occur. We undertake to minimise such changes but reserve the right to make them as is necessary. In the event of a significant ‘material change’ we will of course notify you and allow you to either; accept the change, purchase an alternative holiday from us, or cancel your holiday and receive a full refund.

 

11. Cancellation By Chamonix Exclusive

 

In the unlikely event we have to cancel your holiday, all monies paid will be returned in full.

 

In circumstances beyond our control which include events amounting to ‘force majeure’ (such circumstances include riot, war, industrial dispute, terrorist activity, natural or nuclear disaster, fire, technical problems with transport, closure or congestion of airports or ports, adverse weather conditions, etc) are not the responsibility of Chamonix Exclusive and clients should check their travel insurance policy and ensure, should they so wish, that such are covered accordingly.

 

12. Price Guarantee

 

Whilst we reserve the right to change our prices, your confirmation invoice price is fully guaranteed and will not be subject to change without agreement.

 

However, should events beyond the control of Chamonix Exclusive occur that require a surcharge to be applied, Chamonix Exclusive will notify the client of such charges and the Client may in such circumstances either accept the surcharge, or cancel your holiday with all monies that have been paid returned to you by Chamonix Exclusive in full.

 

13. Behaviour

 

The customer must undertake to behave in such a manner as not to disrupt the enjoyment of other guests staying in the chalet or the residents and guests in surrounding chalets, or when using transportation provided by Chamonix Exclusive or its Third Party Providers.

 

Guests being, or found to have been; rude, offensive, aggressive, swearing or acting inappropriately to a guest, a member of staff, or any person in the resort, in such cases Chamonix Exclusive reserve the right to terminate the holiday immediately without compensation. In such a case Chamonix Exclusive will have no further obligation to them and no monies will be refunded.

 

Any damages and breakages must be notified to Chamonix Exclusive immediately and may be charged to the customer. Damages, other than small incidental damages  that are accidental and could not have been reasonably avoided (accidents caused under the influence of alcohol would not however be excluded); will be subject to a minimum £20 administration or 20% surcharge (whichever is the greater) on top of the repair or replacement costs. Parents with children are responsible for any damage that they may cause and their supervision accordingly.

 

For the avoidance of doubt, clients taken ill and causing damage or additional cleaning requirements, as a result of the influence of alcohol, will be subject to this damages clause and additional administration fee £100 to the fees stated above.

 

Customers must not solicit, encourage or allow non-residents to use the chalet, its facilities or services without prior written agreement from Chamonix Exclusive and failure to adhere to this Chamonix Exclusive reserve the right to terminate the holiday immediately without compensation and / or charge a £1,000 surcharge in such cases.

 

14. Winter – Catering Options (Luxury, Family or Self Catering)

 

Luxury Catering – Chef for 7 night stays:

 

Catering offered by a ‘in-house’ or ‘third party’ professional chef commissioned by Chamonix Exclusive on behalf of the client:

 

The menu includes: cooked breakfast, continental spread with fresh coffee, fruit juices, cereals, French bread, preserves, and freshly baked croissants. Afternoon tea and cakes are offered each day.

 

Dinner is four courses of a good standard of cuisine produced by our professional chef with selected fine wines from across France on 5 nights. Early 2-course supper option is available for children. Dinner is not included on two nights.

 

Standard cleaning at the end of your holiday is included. However, any cleaning deemed as excessive by Chamonix exclusive will be charged at £50 per hour.

 

Family Catering – Host for 7 nights:

 

Catering offered by our chalet host. The menu includes: a continental breakfast with fresh coffee, fruit juices, cereals, French bread, preserves, and freshly baked croissants with a cooked option. Afternoon tea and cakes are offered each day.Dinner is 3 courses cooked and served by our host ‘family style’, to the group at the same time with selected wines on 5 nights

 

In all cases wine may be restricted to a maximum of one bottle of wine per guest at Chamonix Exclusive’s discretion. Wine consumed outside of these times will be charged accordingly.

 

In all cases evening meals are provided on 5 nights. Members of staff have one day off per week and one other evening. On the staff day off, buffet breakfast and afternoon tea is provided (set up the night before for self service). Dinner is not included on two nights.

 

For shorter breaks and variances to the standard offer please refer to the offer email you will have received from Chamonix Exclusive.

 

To ensure and maintain the enjoyment of all guests during the holiday, staff may refuse to serve alcohol to guests where a guest is considered to be unfit for further consumption of alcohol, or if the guests causes or has caused concern in respect of their behaviour under the influence. All guests are drawn to point 13 in respect of behaviour that applies.

 

Standard cleaning at the end of your holiday is included. However, any cleaning deemed as excessive by Chamonix exclusive will be charged at £50 per hour.

 

Self-Catering:

 

On your day of arrival our host will meet and greet you at the chalet. You will be handed a set of keys and information on your stay at the chalet. The host will also receive your damage deposit unless it has been paid in advance. The host can also assist with organizing any additional services, please note concierge services are charged according to our tariffs. Any problems should be highlighted immediately to our host during your stay.

 

Also included in your stay are logs for the fire, a standard electricity charge and end of stay standard cleaning. However, any cleaning deemed as excessive by Chamonix exclusive will be charged at £50 per hour.

 

For all self-catering weeks a damage deposit is required please enquire for details.

 

15. Nanny Service

 

Where a nanny service or baby-sitting service is requested the contract shall be between the client and the baby sitter or the baby-sitting agency and not with Chamonix Exclusive. Parents and Guardians are responsible for ensuring they comply with the law in such situations and take appropriate diligence too.

 

16. No Smoking Policy

 

Chamonix Exclusive operates a very strict no smoking policy. Smoking is not permitted inside the chalet or in the vicinity of entrance doors or windows. Guests may smoke in the gardens and decking areas providing the smoke does not enter the chalet, and that residue cigarette ends, cigars, or tobacco are removed and disposed of safely in the appropriate outside refuse bins. The holiday of any customer or party in breach of this clause may be terminated immediately and without compensation and Chamonix Exclusive will have no further obligation to them.

An additional surcharge  of £1,000 per person violating this clause shall apply to each guest failing to comply, plus any cleaning and or repair costs required to put back the condition of the chalet to the original condition. The latter shall be subject to applicable Clauses above.

 

17. Pets

 

Pets are strictly not allowed in or around the chalet without the written agreement of Chamonix Exclusive. Chamonix Exclusive may terminate any agreement, without default, where Pets are taken into Ski In Ski Out Chalet No.5 without their permission, and apply a surcharge of £1,000 plus any cleaning and or repair costs required to put back the condition of the chalet to the original condition.

 

Where pets have been agreed, the Client will be responsible for ensuring that no damage or additional cleaning results from hosting them. Any such damage, repairs, or additional cleaning will be subject to the Charges detailed above (pets will be treated and Client charged, as normal guests would be).

 

18. Arrival, Departure Times & Condition Of Chalet On Departure

 

The chalet and rooms will be available from 4.00pm on the day of arrival.

 

The chalet must be vacated by 10.00am on the day of departure to enable cleaning for incoming guests. The chalet should be left in a good condition. Where the chalet is left in a condition that requires additional cleaning, over and above what would be normally expected, Chamonix Exclusive reserve the right to charge costs, including administration, for the additional service requirement as previously detailed.

 

Early or late departures will be subject to a charge unless agreed by prior arrangement with Chamonix Exclusive.

 

19. Complaints

 

Whilst we take all reasonable care to ensure that your holiday with us is an enjoyable one, from time to time complaints may arise. If you have a complaint please inform the Chamonix Exclusive resort representative immediately who will endeavor to resolve the problem. If you are unable to contact the resort representative or do not get a satisfactory conclusion, you should contact the help number immediately (given to you on the arrival day) or email frances@chamonixexclusive.com immediately.

 

Please do not leave it to the end of the week, the end of, or after your stay where rectification is not possible and circumstances challenging to substantiate or otherwise. Complaints not raised immediately at the time of incurrence may be treated as null and void at the discretion of Chamonix Exclusive.

 

Evidence must be retained / provided in such cases where reasonable to do so and applicable to enable collaboration or otherwise of the complaint.

 

20. Liability

 

Chamonix Exclusive accepts no responsibility for the acts or omissions of its clients, whether negligent or otherwise, and shall not be held liable for any claims made against them.

 

21. Visas

 

It is your responsibility to be in possession of a valid passport and any visa as necessary before travelling. Non EU Passport holders should note that the local airport, Geneva, is not a EU member country.

 

22. Law & Jurisdiction

 

These conditions and any contract to which they apply are governed in all respects by French Law and are subject to the jurisdiction of the courts in France. As a consequence of this, in any formal dispute ascertaining or otherwise to these Terms and Conditions we reserve the right to ask for all correspondence to be in French only.
